Legal Checklist Before Buying an Apartment or Villa

Before you sign on the dotted line, make sure your dream home is legally clean and future-proof. Here's what to verify:

Title Deed

  • Confirms legal ownership of the property

  • Must be in the seller’s name and free from disputes

Sale Deed

  • The final proof of ownership transfer

  • Must be registered at the Sub-Registrar’s Office

Encumbrance Certificate (EC)

  • Shows if the property has any legal dues or loans

  • Get EC for at least the past 13–30 years

Building Plan Approval

  • Issued by the local municipal authority

  • Confirms the construction follows zoning and safety norms

Completion Certificate (CC)

  • Confirms the building is constructed as per approved plans

Occupancy Certificate (OC)

  • Confirms the building is fit for living

  • Mandatory before moving in or renting

Khata Certificate / Mutation Record

  • Registers the property in your name for tax and civic purposes

Property Tax & Utility Dues

  • Ensure all property tax, water, and electricity bills are paid up to date

No Objection Certificates (NOCs)

  • From fire, water, electricity, and environmental departments

  • Especially important for large projects

RERA Registration

  • Check if the project and builder are registered under RERA

  • Visit your state’s RERA portal (e.g., )

Power of Attorney (if applicable)

  • Ensure it’s registered and specific to the transaction

Legal Due Diligence

  • Get a real estate lawyer to verify all documents and highlight red flags
